Agricola D\u2019Alba Giuseppe<\/strong> (the \u201cSeller\u201d) by users\/customers (the \u201cCustomer\u201d).<\/p>\n<p>The offer and sale of products on the Website comply with the applicable laws on e-commerce and distance selling.<\/p>\n<p>Before placing an order, the Customer is invited to carefully read these Terms. Agricola D\u2019Alba Giuseppe<\/strong><br \/>\nRegistered office: <strong>73020 Uggiano La Chiesa (LE), Italy<\/strong><br \/>\nVAT No.: <strong>05281480755<\/strong><br \/>\nEmail: <strong>info@tenutadalba.com<\/strong><br \/>\nPhone: <strong>+39 351 485 6547<\/strong><\/p>\n<ol start=\"3\">\n<li><strong> Definitions<\/strong><\/li>\n<\/ol>\n<ul>\n<li><strong>Website<\/strong>: the Seller\u2019s online shop.<\/li>\n<li><strong>Products<\/strong>: the goods sold on the Website (e.g. extra virgin olive oil and related products).<\/li>\n<li><strong>Customer<\/strong>: any person purchasing Products through the Website.<\/li>\n<li><strong>Consumer<\/strong>: a natural person acting for purposes outside any trade, business or profession.<\/li>\n<li><strong>Professional<\/strong>: any natural or legal person acting for purposes related to their trade, business or profession.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><strong> Products: characteristics, images and availability<\/strong><\/li>\n<\/ol>\n<p>The essential characteristics of the Products are described in the relevant product pages on the Website.<\/p>\n<p>Product images are for illustrative purposes only and may slightly differ from the actual Product (e.g. label, colour tone, photographic rendering), without affecting the nature or quality of the Product.<\/p>\n<p>Product availability is shown on the Website. If a Product becomes unavailable after an order is placed, the Seller will promptly inform the Customer and offer the choice to:<\/p>\n<ul>\n<li>wait for restocking (if available within an indicative maximum term of <strong>30 business days<\/strong>), or<\/li>\n<li>receive a refund of any amounts paid for unavailable Products.<\/li>\n<\/ul>\n<p>The Customer is responsible for the selection of the Products ordered.<\/p>\n<ol start=\"5\">\n<li><strong> Prices<\/strong><\/li>\n<\/ol>\n<p>Unless otherwise stated, prices are expressed in <strong>Euros<\/strong> and include <strong>VAT<\/strong> (where applicable).<br \/>\nShipping costs and any additional charges are indicated before order confirmation.<\/p>\n<p>The price applied is the one published on the Website at the time the order is placed and is final for that order.<\/p>\n<ol start=\"6\">\n<li><strong> Orders and contract conclusion<\/strong><\/li>\n<\/ol>\n<p>Placing an order constitutes a contractual offer by the Customer.<br \/>\nThe contract is concluded when the Customer receives the <strong>order confirmation email<\/strong>, containing a summary of the Products purchased, prices, shipping costs, delivery address and any other relevant information.<\/p>\n<p>The Seller reserves the right not to accept or to cancel an order, in particular in case of:<\/p>\n<ul>\n<li>Product unavailability;<\/li>\n<li>obvious errors in price or description;<\/li>\n<li>incomplete or unverifiable data;<\/li>\n<li>suspected fraud or unauthorised use of payment methods.<\/li>\n<\/ul>\n<ol start=\"7\">\n<li><strong> Payments<\/strong><\/li>\n<\/ol>\n<p>Payment is due at the time the order is placed.<br \/>\nThe accepted payment methods are those indicated on the Website (e.g. credit\/debit card, PayPal, advance bank transfer). <strong>Cash on delivery is not available.<\/strong><\/p>\n<p>For bank transfers, the order will be processed upon receipt of funds. If payment is not received within <strong>10 days<\/strong> from order confirmation, the Seller reserves the right to cancel the order.<\/p>\n<p>For deliveries to countries where customs duties or import charges may apply (e.g. non-EU countries), such costs shall be borne by the Customer.<\/p>\n<ol start=\"8\">\n<li><strong> Invoicing \/ tax documentation<\/strong><\/li>\n<\/ol>\n<p>Tax documentation will be issued in accordance with applicable laws.<br \/>\nIf the Customer requires an invoice, correct and complete billing details must be provided at checkout (including SDI\/PEC where applicable).<\/p>\n<ol start=\"9\">\n<li><strong> Shipping and delivery<\/strong><\/li>\n<\/ol>\n<p>Products are delivered to the address provided by the Customer.<br \/>\nShipment will take place after payment confirmation.<\/p>\n<p>The Seller may use qualified express couriers (e.g. GLS, UPS, DHL, BRT).<\/p>\n<p><strong>Shipping fees<\/strong><\/p>\n<ul>\n<li><strong>Italy<\/strong>: flat rate <strong>\u20ac8.00<\/strong>; <strong>free shipping for orders over \u20ac100.00<\/strong><\/li>\n<li><strong>Europe (international)<\/strong>: variable rate based on weight\/destination (calculated at checkout or communicated before payment)<\/li>\n<\/ul>\n<p><strong>Indicative delivery times<\/strong><\/p>\n<ul>\n<li><strong>Italy<\/strong>: within <strong>7 business days<\/strong> for available Products<\/li>\n<li><strong>European destinations<\/strong>: within <strong>15 business days<\/strong> for available Products<\/li>\n<\/ul>\n<p>Delivery times are indicative and non-binding. Delays of less than <strong>30 days<\/strong> do not entitle the Customer to refuse delivery or claim compensation.<\/p>\n<p>The Seller may make partial deliveries for the same order, where reasonably necessary, at no additional cost.<br \/>\nDeliveries are made at street level, unless otherwise agreed.<\/p>\n<ol start=\"10\">\n<li><strong> Delivery check \u2013 transport damage<\/strong><\/li>\n<\/ol>\n<p>Upon delivery, the Customer is invited to check:<\/p>\n<ul>\n<li>that the number of parcels matches the transport document;<\/li>\n<li>that the packaging is intact and not damaged or wet;<\/li>\n<li>that the contents match the order.<\/li>\n<\/ul>\n<p>In case of visible damage, the Customer must:<\/p>\n<ul>\n<li>refuse delivery, or<\/li>\n<li>accept with <strong>specific reservation<\/strong> (describing the damage on the courier\u2019s document).<\/li>\n<\/ul>\n<p>Any damage or missing items must also be reported to the Seller within <strong>3 (three) days<\/strong> of delivery, by email to <strong>info@tenutadalba.com<\/strong>, attaching photos of the package and contents.<\/p>\n<p>If the courier\u2019s document is signed without reservation, the possibility to claim visible external damage may be limited.<\/p>\n<ol start=\"11\">\n<li><strong> Failed delivery \/ incorrect address<\/strong><\/li>\n<\/ol>\n<p>If the recipient is absent, the courier will attempt delivery or place the shipment in storage according to its procedures.<\/p>\n<p>If the parcel is returned to the Seller due to failed delivery or an incorrect address attributable to the Customer, the Seller may:<\/p>\n<ul>\n<li>refund the price of the Products, retaining the shipping costs incurred (outbound and\/or return) and any storage\/handling costs, or<\/li>\n<li>arrange a new shipment at the Customer\u2019s expense.<\/li>\n<\/ul>\n<ol start=\"12\">\n<li><strong> Right of withdrawal (Consumers only)<\/strong><\/li>\n<\/ol>\n<p>If the Customer is a <strong>Consumer<\/strong>, they have the right to withdraw from the contract within <strong>14 days<\/strong> from the day they receive the Products, without giving any reason.<\/p>\n<p><strong>How to exercise the right of withdrawal<\/strong><\/p>\n<p>The Customer must send a clear notice within 14 days to:<br \/>\n&#x1f4e7; <strong>info@tenutadalba.com<\/strong><br \/>\nstating at least:<\/p>\n<ul>\n<li>order number<\/li>\n<li>name and surname<\/li>\n<li>address<\/li>\n<li>Products to be returned<\/li>\n<\/ul>\n<p><strong>Return of Products<\/strong><\/p>\n<p>Products must be returned within <strong>14 days<\/strong> from the withdrawal notice, intact, unused beyond what is necessary to verify their nature and characteristics, and preferably in the original packaging.<\/p>\n<p><strong>Return shipping costs are borne by the Customer<\/strong>, except in case of defective or non-conforming Products.<\/p>\n<p><strong>Refunds<\/strong><\/p>\n<p>Once the returned Products have been received and inspected, the Seller will refund:<\/p>\n<ul>\n<li>the price of the returned Products;<\/li>\n<li>the standard outbound shipping costs (where due and within the limits set by law).<\/li>\n<\/ul>\n<p>The refund will be made within <strong>14 days<\/strong> of receipt of the return or proof of shipment of the return.<\/p>\n<p><strong>Exclusions<\/strong><\/p>\n<p>The right of withdrawal may be excluded in cases provided by law, for example for sealed goods that are not suitable for return for hygiene reasons once opened after delivery.<\/p>\n<ol start=\"13\">\n<li><strong> Defective or non-conforming Products \u2013 Legal warranty<\/strong><\/li>\n<\/ol>\n<p>Consumers benefit from the legal warranty of conformity provided by applicable law.<br \/>\nIn case of non-conforming Products, the Customer may contact the Seller at <strong>info@tenutadalba.com<\/strong>, indicating:<\/p>\n<ul>\n<li>order number<\/li>\n<li>description of the issue<\/li>\n<li>supporting photos<\/li>\n<\/ul>\n<p>The Seller will assess and handle the claim according to the remedies provided by law.<\/p>\n<ol start=\"14\">\n<li><strong> Complaints and customer support<\/strong><\/li>\n<\/ol>\n<p>For any information or complaint:<br \/>\n&#x1f4e7;
