  1. Premise

These General Terms and Conditions of Sale (the “Terms”) govern the purchase of products made through the e-commerce website of Az. Agricola D’Alba Giuseppe (the “Seller”) by users/customers (the “Customer”).

The offer and sale of products on the Website comply with the applicable laws on e-commerce and distance selling.

Before placing an order, the Customer is invited to carefully read these Terms. Submitting an order implies full acceptance of these Terms.

  1. Definitions
  • Website: the Seller’s online shop.
  • Products: the goods sold on the Website (e.g. extra virgin olive oil and related products).
  • Customer: any person purchasing Products through the Website.
  • Consumer: a natural person acting for purposes outside any trade, business or profession.
  • Professional: any natural or legal person acting for purposes related to their trade, business or profession.
  1. Products: characteristics, images and availability

The essential characteristics of the Products are described in the relevant product pages on the Website.

Product images are for illustrative purposes only and may slightly differ from the actual Product (e.g. label, colour tone, photographic rendering), without affecting the nature or quality of the Product.

Product availability is shown on the Website. If a Product becomes unavailable after an order is placed, the Seller will promptly inform the Customer and offer the choice to:

  • wait for restocking (if available within an indicative maximum term of 30 business days), or
  • receive a refund of any amounts paid for unavailable Products.

The Customer is responsible for the selection of the Products ordered.

  1. Prices

Unless otherwise stated, prices are expressed in Euros and include VAT (where applicable).
Shipping costs and any additional charges are indicated before order confirmation.

The price applied is the one published on the Website at the time the order is placed and is final for that order.

  1. Orders and contract conclusion

Placing an order constitutes a contractual offer by the Customer.
The contract is concluded when the Customer receives the order confirmation email, containing a summary of the Products purchased, prices, shipping costs, delivery address and any other relevant information.

The Seller reserves the right not to accept or to cancel an order, in particular in case of:

  • Product unavailability;
  • obvious errors in price or description;
  • incomplete or unverifiable data;
  • suspected fraud or unauthorised use of payment methods.
  1. Payments

Payment is due at the time the order is placed.
The accepted payment methods are those indicated on the Website (e.g. credit/debit card, PayPal, advance bank transfer). Cash on delivery is not available.

For bank transfers, the order will be processed upon receipt of funds. If payment is not received within 10 days from order confirmation, the Seller reserves the right to cancel the order.

For deliveries to countries where customs duties or import charges may apply (e.g. non-EU countries), such costs shall be borne by the Customer.

  1. Invoicing / tax documentation

Tax documentation will be issued in accordance with applicable laws.
If the Customer requires an invoice, correct and complete billing details must be provided at checkout (including SDI/PEC where applicable).

  1. Shipping and delivery

Products are delivered to the address provided by the Customer.
Shipment will take place after payment confirmation.

The Seller may use qualified express couriers (e.g. GLS, UPS, DHL, BRT).

Shipping fees

  • Italy: flat rate €8.00; free shipping for orders over €100.00
  • Europe (international): variable rate based on weight/destination (calculated at checkout or communicated before payment)

Indicative delivery times

  • Italy: within 7 business days for available Products
  • European destinations: within 15 business days for available Products

Delivery times are indicative and non-binding. Delays of less than 30 days do not entitle the Customer to refuse delivery or claim compensation.

The Seller may make partial deliveries for the same order, where reasonably necessary, at no additional cost.
Deliveries are made at street level, unless otherwise agreed.

  1. Delivery check – transport damage

Upon delivery, the Customer is invited to check:

  • that the number of parcels matches the transport document;
  • that the packaging is intact and not damaged or wet;
  • that the contents match the order.

In case of visible damage, the Customer must:

  • refuse delivery, or
  • accept with specific reservation (describing the damage on the courier’s document).

Any damage or missing items must also be reported to the Seller within 3 (three) days of delivery, by email to [email protected], attaching photos of the package and contents.

If the courier’s document is signed without reservation, the possibility to claim visible external damage may be limited.

  1. Failed delivery / incorrect address

If the recipient is absent, the courier will attempt delivery or place the shipment in storage according to its procedures.

If the parcel is returned to the Seller due to failed delivery or an incorrect address attributable to the Customer, the Seller may:

  • refund the price of the Products, retaining the shipping costs incurred (outbound and/or return) and any storage/handling costs, or
  • arrange a new shipment at the Customer’s expense.
  1. Right of withdrawal (Consumers only)

If the Customer is a Consumer, they have the right to withdraw from the contract within 14 days from the day they receive the Products, without giving any reason.

How to exercise the right of withdrawal

The Customer must send a clear notice within 14 days to:

  • order number

  • address
  • Products to be returned

Return of Products

Products must be returned within 14 days from the withdrawal notice, intact, unused beyond what is necessary to verify their nature and characteristics, and preferably in the original packaging.

Return shipping costs are borne by the Customer, except in case of defective or non-conforming Products.

Refunds

Once the returned Products have been received and inspected, the Seller will refund:

  • the price of the returned Products;
  • the standard outbound shipping costs (where due and within the limits set by law).

The refund will be made within 14 days of receipt of the return or proof of shipment of the return.

Exclusions

The right of withdrawal may be excluded in cases provided by law, for example for sealed goods that are not suitable for return for hygiene reasons once opened after delivery.

  1. Defective or non-conforming Products – Legal warranty

Consumers benefit from the legal warranty of conformity provided by applicable law.
In case of non-conforming Products, the Customer may contact the Seller at [email protected], indicating:

  • order number
  • description of the issue
  • supporting photos

The Seller will assess and handle the claim according to the remedies provided by law.

  1. Force majeure

The Seller shall not be liable for delays or failure to perform due to events of force majeure (e.g. strikes, transport disruptions, governmental restrictions, IT failures, telecommunications/network interruptions, natural events).

  1. Personal data protection

Personal data are processed in accordance with applicable data protection laws and as described in the Privacy Policy and Cookie Policy published on the Website.

  1. Intellectual property

All content, trademarks, logos, texts and images on the Website are protected by intellectual property rights and may not be reproduced or used without authorisation.

  1. Partial invalidity

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain valid and effective.

  1. Governing law and jurisdiction

These Terms are governed by Italian law.

  • If the Customer is a Consumer, any dispute shall be subject to the mandatory jurisdiction provided by consumer protection laws.
  • If the Customer is a Professional, any dispute shall fall under the exclusive jurisdiction of the Court of Lecce (Italy).
  1. Alternative Dispute Resolution (ADR/ODR)

Consumers may use alternative dispute resolution (ADR) mechanisms.
If resident in the European Union, Consumers may also use the European Commission’s ODR platform (link to be provided on the Website).
